| Resumen: |
Este libro analiza la evolución actual en Europa y América Latina hacia una mayor participación de las partes en la administración de justicia penal. Centrándose tanto en los procedimientos penales nacionales como en los casos transnacionales, este estudio emplea un enfoque de derecho comparado para examinar el cambio experimentado por Italia y Brasil desde la larga tradición de justicia penal mixta hacia tendencias contradictorias sin precedentes. La identificación de necesidades comunes y divergencias con respecto al enfoque nacional de la justicia penal allana el camino para un análisis posterior de nuevos modelos de solución que surjan del derecho internacional de los derechos humanos y del derecho de la UE. En gran medida, estos acontecimientos se deben al creciente impacto de la jurisprudencia internacional de derechos humanos en los sistemas de justicia penal de los paÃses en cuestión. El libro concluye proponiendo un conjunto de requisitos cualitativos para un modelo participativo de justicia penal. |
