Abstract
The research aims to understand the position of the Constitutional Court in the judgment C-654 of 2007 to resolve the tension existing in Colombian legislation between the Right to Education and University Autonomy in the definition of Undergraduate Law by Higher Education Institutions. This objective is justified by the jurisprudential understanding that education is a right that requires certain conditions to guarantee access, permanence and completion, reiterated by the Constitutional Court when saying that educational institutions must ensure a guarantor approach, especially when it comes to vulnerable people (C. Const., T-097 of 2016). The methodology used is documentary and jurisprudential, analyzing judgments such as C-654 of 2007, which established that university fees are legitimate only to the extent that they do not violate the essential core of the right to education, limiting institutional autonomy. Among the main results is that the Court has defined criteria of reasonableness and proportionality to determine whether pecuniary charges create illegitimate barriers, and has reiterated that universities must submit to the Social Rule of law and avoid administrative measures that, due to their pecuniary nature, prevent the completion of the training process. In conclusion, the study shows that there are still regulatory gaps in the regulation of undergraduate rights and that it is necessary to create legislative guidelines that balance university autonomy and the guarantee of the fundamental right to education. |
