This research analyzes the phenomenon of constitutional mutation in Colombia, specifically focusing on the transformation of sexual and reproductive health and rights (SRHR) through the jurisprudence of the Constitutional Court. Using a qualitative-interpretative and dogmatic-legal approach, the study explores how the Court has redefined the scope of these rights without modifying the text of the 1991 Constitution. The paper identifies six fundamental interpretative axes that sustain this mutation: unnamed rights, human dignity, the Block of Constitutionality, the principle of equality, personal autonomy, and the principle of progressivity. Through the analysis of jurisprudential milestones it is demonstrated that the Constitution acts as a "living system" capable of responding to contemporary demands for justice and human dignity. The study concludes that jurisprudential mutation has been an indispensable tool for guaranteeing the effectiveness of SRR within the framework of the Social State of Law. |
