En los últimos años se han producido avances extraordinarios en el campo de la neurociencia, que han suscitado numerosos debates en el ámbito jurídico. Este libro estudia las diversas interacciones entre la neurociencia y el mundo del derecho, y explora cómo los hallazgos neurocientíficos podrían afectar a algunas categorías jurídicas fundamentales y cómo debería aplicarse el derecho en tales casos. El libro se divide en tres partes principales. Partiendo de una visión general de la convergencia de la neurociencia y el derecho, la primera parte esboza la importancia de su interacción continua, los retos que la neurociencia plantea a los conceptos de libre albedrío y responsabilidad, y las características peculiares de una “nueva” libertad cognitiva. A su vez, la segunda parte aborda el fenómeno del mejoramiento cognitivo y moral, así como los usos de la neurotecnología y sus impactos en la salud, la autodeterminación y el concepto de ser humano. La tercera y última parte investiga el uso de los hallazgos neurocientíficos tanto en casos penales como civiles, y busca determinar si pueden proporcionar evidencia valiosa y facilitar la evaluación de la responsabilidad personal, ayudando a resolver los casos. El libro es el resultado de un diálogo interdisciplinario que involucra a juristas, filósofos, neurocientíficos, especialistas en medicina forense y académicos en humanidades; además, está dirigido a un público amplio interesado en comprender los impactos de los avances científicos y tecnológicos en la vida de las personas y en nuestros sistemas sociales. |
