Este libro aborda los principales desafÃos y conflictos que surgen en las industrias extractivas (minerÃa, extracción de petróleo) en relación con los derechos humanos de los trabajadores, sus familias, las comunidades locales y otras partes interesadas. Además, analiza varios instrumentos que han buscado mitigar las violaciones de derechos humanos mediante la definición de obligaciones relacionadas con la transparencia y derechos de participación. Estos incluyen la Iniciativa para la Transparencia de las Industrias Extractivas (EITI), los requisitos de divulgación y el consentimiento libre, previo e informado (CLPI). El libro evalúa crÃticamente estos instrumentos, demostrando que, en algunos casos, producen efectos no deseados. Además, destaca la importancia de la resistencia a los proyectos de industrias extractivas como respuesta a las violaciones de derechos humanos y analiza cómo la transparencia, la participación y la resistencia están interconectadas. |

This book addresses key challenges and conflicts arising in extractive industries (mining, oil drilling) concerning the human rights of workers, their families, local communities and other stakeholders. Further, it analyses various instruments that have sought to mitigate human rights violations by defining transparency-related obligations and participation rights. These include the Extractive Industries Transparency Initiative (EITI), disclosure requirements, and free, prior and informed consent (FPIC). The book critically assesses these instruments, demonstrating that, in some cases, they produce unwanted effects. Furthermore, it highlights the importance of resistance to extractive industry projects as a response to human rights violations, and discusses how transparency, participation and resistance are interconnected. |
