| Resumen: |
Este volumen analiza la justicia penal de la UE desde tres perspectivas. El primero se refiere a los derechos fundamentales tras la adopción de directivas que han reforzado progresivamente la piedra angular de los derechos procesales de los sospechosos y acusados en los procesos penales nacionales en los Estados miembros de la UE para facilitar la cooperación judicial. La segunda perspectiva se refiere a las investigaciones y procedimientos penales transnacionales, que se consideran una sección transversal del estado actual de la cooperación judicial en el espacio de libertad, seguridad y justicia, con las cuestiones conexas de eficiencia, coordinación, solución de conflictos de jurisdicción, y garantías. La tercera perspectiva se refiere al desarrollo de un sistema de justicia supranacional a la luz de la recientemente creada Fiscalía Europea, cuya naturaleza judicial europea aún coexiste con fuertes componentes nacionales. |
